Understanding the issue
Separation of Title is a term used in conveyancing, when home or land-owners wish to sell or gift part of their property as opposed to all of it. This requires different legal documents and advice should be given, taking into account the proposed use for the part of the property or land being sold, in addition to the part of the property or land being retained. Legal rights (Easements) must be recorded into the documents to minimise any issues for both parts of the property/land in the future.
At MSB, our experts advise on separation of title on a case-by-case basis, taking into consideration the reasons for the separation of title, any likely future events that might take place at the property or land and the intention of the parties in relation to it being transferred and retained.
