Understanding the issue
The major selling point of a bridging loan is the fast pace that the lenders are able to process the borrowers application, obtain the necessary valuations and complete the legal work required in order to release funds to the borrower on completion of the loan. Bridging loans are typically for a term of 3-18 months with the borrowers often not requiring a long term facility due to the nature of their plans for the asset being secured.
We understand how crucial the solicitor’s role is within bridging transactions. When acting for the lender we ensure that security being offered has a good and marketable title and that we protect the lenders interests should the borrower fall into financial difficulty and no longer be able to service the loan.
When acting on behalf of our lender client we are responsible for ensuring the accurate drafting of the security documentation, in a bridging loan to a corporate borrower we generally prepare the following documentation:
- Facility letter
- Legal Charge
- Debenture
- Personal Guarantee
When acting for a borrower it is crucial to ensure that we advise the client on the major terms of the loan documentation including items such as default interest or actions that lead to an event of default.
