Successive governments have highlighted the need for affordable home-ownership options. We act for a number of social housing providers and local authorities in relation to the legal and practical aspects of helping people get on to the property ladder.
The types of matters that our team can provide support on include:
- Right to Buy
- Right to Acquire
- Shared Ownership (including staircasing)
- Rent to Buy
- Drafting policies, procedures, standard documentation through to the conveyance
- Enfranchisement
- Disputes between homeowners and tenants on mixed tenure developments
- Advice on consents under restrictive covenants
- Assisting with advice and documentation for assignment of interests

“MSB is both efficient and competent. The staff members that I have come into contact with are always helpful, knowledgeable and polite. They are one of the few firms who send a clerk to sit with the client and counsel. This is an invaluable service to both parties.”
Understanding the issue
In the development of home ownership stock, we understand the sensitive relationships that exist between social landlords, developers, landowners and other stakeholders. We have experience of providing both commercial and practical advice and assistance to maintain these relationships and achieve our clients’ goals and help to avoid disputes.
To help you understand and manage home ownership stock effectively, we provide a range of training sessions, practice guides and precedent documentation. We are also able to provide bespoke training and standard documentation to fit your organisation.
We understand the many issues that can arise when managing home ownership stock. We will consider all of the options available with you to help resolve any disputes without the need to issue Court proceedings. We are keen advocates of Alternative Dispute Resolution.
Unfortunately, not all matters can be resolved without litigation. If proceedings are issued, our Property Litigation team have extensive experience in dealing with property cases whether in the County Court, First Tier Tribunal (Property Chamber) or complex Chancery matters.
Why MSB?
In 2018, MSB acquired specialist social housing and Legal 500 recommended law firm, Knox Ellis, as a cornerstone of its Social Housing and Regeneration team. The team has continued to build on the excellent reputation of Knox Ellis and works with a diverse range of social landlords across the North.
As a result of our years of experience and breadth of work, we fully understand and appreciate the environment within which our clients work, as such we know what works and we know how to communicate our advice in a no-nonsense, straight forward, friendly manner in order to get the job done.
Whether you are looking for advice on a policy to recover shared ownership arrears, conveying multiple plots or are faced with an application for collective enfranchisement, we have the expertise and scale to manage the process for you.
